Right of Withdrawal

1. Overview
As an EU-based business selling to EU consumers, EuroRAG is subject to Directive 2011/83/EU on consumer rights. This page explains how the right of withdrawal applies, and doesn't apply, to your purchase of EuroRAG, and reproduces the model withdrawal form required by the Directive.
2. The 14-day right of withdrawal
Under Article 16 of Directive 2011/83/EU, consumers purchasing digital content not supplied on a tangible medium have a 14-day right of withdrawal from the contract, unless one of the exemptions in Article 16 applies. For EuroRAG, the relevant exemption is Article 16(m): the right of withdrawal does not apply to "the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal."
3. How EuroRAG invokes Article 16(m) at checkout
To trigger the Article 16(m) exemption, two conditions must be met before delivery begins:
- The consumer's prior express consent to begin performance and lose the right of withdrawal.
- The consumer's acknowledgment that they thereby lose the right of withdrawal.
EuroRAG collects both via a mandatory checkbox at Stripe Checkout before payment is processed. The checkbox text states that by purchasing, the buyer requests immediate access to the private repository and acknowledges losing their 14-day right of withdrawal under Article 16(m) once repository access is granted. The purchase cannot complete without the checkbox being ticked.
4. When withdrawal still applies
The Article 16(m) exemption only takes effect once performance has begun; for EuroRAG, that is the moment repository access is granted. Before that moment, the consumer retains the full 14-day right of withdrawal.
If you have purchased EuroRAG and repository access has not yet been granted (typically within minutes, but no later than 24 hours of payment), you may exercise your right of withdrawal within 14 days of purchase by contacting [email protected]. Upon valid withdrawal in this window, we will issue a full refund.
5. Business-to-business (B2B) transactions
The right of withdrawal under Directive 2011/83/EU applies only to consumers, meaning natural persons acting for purposes outside their trade, business, craft, or profession (Article 2(1)). If you are purchasing EuroRAG for use in your business, trade, or profession, you are not a consumer for the purposes of this Directive and the right of withdrawal does not apply.
6. Conformity rights under the Digital Content Directive
Independently of the right of withdrawal, EU consumers purchasing digital content are protected by Directive (EU) 2019/770 (the Digital Content Directive) on certain aspects concerning contracts for the supply of digital content and digital services. Where it applies, it gives you rights regarding conformity (the software must match the description, be fit for purpose, and contain the features described) and a tiered remedies ladder (price reduction, termination, damages) where conformity is lacking.
7. Failed or delayed delivery
If we fail to deliver access to the repository, or delivery is materially delayed beyond the 24-hour window stated in Terms §5, the Article 16(m) waiver does not take effect (no performance has begun) and your 14-day right of withdrawal remains intact. In that case you may either withdraw for a full refund or hold us to delivery.
8. Model withdrawal form
Where a right of withdrawal applies (see Sections 1 and 3), you may use this form, though you are not obliged to; any unequivocal statement of your decision to withdraw is sufficient.
